Considering it had just recently started, Shane probably did believe that Rick was dead. He felt that Lori and Carl needed him and he definitely loved Lori. he also wasn't in his right mind when Rick returned and felt that he should get to be apart of their lives since he had comforted them through the "loss" of Rick.

When he was at the hospital he checked for vitals when he tried to save Rick but with all the gunfire and chaos happening he didn't feel anything so he GENUINELY thought Rick was dead so when he told Lori that Rick was dead, he really did think he was telling her the truth.
It wasn't a ploy to get with her. He even said that he never had looked at her before all of this. I think it was a genuine mistake but by the time Rick showed up, Shane already loved Lori and you can't just turn live on and off like a switch. So there is where the problem lies.
