Shane couldn't have been locked away like Negan could. Their stay at the farm was only suppose to be temperary and they couldn't leave him with the Greene family (A zombie horde appears and forces everyone away from the farm anyway, but that would still allow Shane to escape and hunt for Rick) . With Rick's group living at a community, Negan can be better watched over. Besides, Negan's cause of damage to Rick and his friends was caused by Rick's group making a first strike against the Saviors. Didn't the saviors strike first with that motor cycle gang? Plus they're way of life was literally demanding conflict. Those satellite station people had collections of bashed heads on the wall. I kinda hoped they would have gone more brutal on the saviors with war reprations and victors justice.
Technically that motor cycle gang didn't strike first since they didn't attack anyone. Plus considering the comments some of the saviors made in the satelite outpost about them, they weren't exactly well liked by the other saviors.
Attempted armed robbery is generally considered a violent offense.
Still doesn't change the fact that Rick's group killed Negan's people first or that the motor cycle gang wasn't liked even among fellow Saviors.
They were collecting for Negan, threatened to shoot both Abraham and Sasha, and Rick's people got first-hand testimony from the Hilltop that Negan bashed a kid's head in, and they saw that the Saviors had sent Ethan to behead Gregory because the Hilltop's slave work was deem unsatisfactory by the Saviors at the Satellite Plant.
Rick was not the first offender.
The only reason Sasha and Abraham were not shot was because Daryl intervened. It wasn't mercy, it wasn't a change of heart. It doesn't matter how well liked those Saviors were, they were running an errand for Negan. You can bet if Negan didn't like how they operated, he would shut it down. He's not afraid to discipline his own people.
Rick killed members of the Saviors first. That makes him the first offender. Negan didn't even know about Daryl killing the motorcycle gang. And robbing is not the same as attacking. And the fact that the other saviors didn't like them does indeed matter as it makes them like Jared, who was even disobeying Gavin for the sake of provoking others.
The whole point is that the saviors way to live makes them the first agressor. The fact is they interfere other people's lives/privacy/community. In case of the Hilltop, they got lucky, but it was clear that they would get Alexandria sooner or later. Rick's strike was completely justified after the data he had gotten from the faction that met Abe/Sasha/Daryl and what he got from the Hilltop. The literally forced one Hilltopper to assasinate Gregory by holding his brother hostage, due to not delievering enough food. Rick's big mistake was not gathering enough information beforehand, plus Jesus could have described what Negan looked like.
The Saviors very way of life invites conflict, so a major offense against the, was only a matter of time whether it was Alexandria, Hilltop, Kingdom or even the workers.
Rick has pretty much never killed someone unless he was a danger, whether on a personal basis or the group.
The Saviors also lack a traumatic experience that makes you sympathaize with them: Rick's group met all kinds of bad people, Kingdom and Hilltop were enslavved/extorted by saviors, the Saviors killed all boys and men of Oceanside, and even the people of Terminus can at least partially be understood for their nithlism/psychopathic worldview (Gareth witnessed his mother being raped for weeks by the one of most heinous group in the TWD-universe).
